Terms and Conditions<\/strong><\/p>

  1. Who We Are and Who We Do Business With<\/strong><\/li><\/ol>

    These terms apply only to businesses<\/strong> \u2013 companies and sole proprietors purchasing within their business activities (B2B).
    They do not apply to consumers.<\/p>

    1. What We Sell<\/strong><\/li><\/ol>

      Based on individual offers or contracts, we primarily supply:<\/p>

      • catering trailers (Airstream, Box, Rounder, and other models),<\/li>
      • standalone catering appliances and equipment,<\/li>
      • LED signs and illuminated advertisements,<\/li>
      • accessories and associated equipment (e.g., movers, spare parts\u2026).<\/li><\/ul>

        In most cases, trailers are custom-made\/modified goods<\/strong> according to customer requirements.<\/p>

        1. How a Contract is Formed<\/strong><\/li><\/ol>

          The process is usually as follows:<\/p>

          1. The customer sends us an inquiry:
            • via the form on the website,<\/li>
            • via a form \/ message from social media (e.g., after clicking an ad),<\/li>
            • by email to info@gastronova.eu<\/strong>,<\/li>
            • by phone or in person.<\/li><\/ul><\/li>
            • Based on the inquiry, we will prepare a non-binding price offer<\/strong>, or a draft contract.<\/li>
            • A contract is formed:
              • by signing the contract by both parties, or<\/li>
              • by written (including email) confirmation of the offer, if agreed upon in advance.<\/li><\/ul><\/li><\/ol>

                These GTC are part of every such contract, unless otherwise agreed in writing.<\/p>

                1. Price and Payments<\/strong><\/li><\/ol>
                  • Prices are quoted excluding VAT<\/strong>, unless explicitly stated otherwise.<\/li>
                  • For custom-ordered catering trailers<\/strong>, we always agree on:
                    • an advance payment,<\/li>
                    • the remaining balance before the trailer handover.<\/li><\/ul><\/li><\/ul>

                      The specific payment schedule<\/strong> (amount of advance payment, remaining balance, and due dates) is always stated in the individual contract or price offer.<\/p>

                      • For trailers and goods from stock<\/strong>, the following may be agreed upon:
                        • a reservation fee<\/strong>,<\/li>
                        • the remaining balance upon delivery of goods or according to the terms specified in the contract \/ order.<\/li><\/ul><\/li>
                        • For smaller products (appliances, LED signs, accessories, etc.), full upfront payment<\/strong> may be required \u2013 the payment method and due date are always specified in the specific offer or during the ordering process.<\/li>
                        • Payment terms also depend on the form of financing<\/strong> (e.g., loan, lease, own resources) and whether it is a custom-ordered product<\/strong> or goods from stock<\/strong>. Specific terms are always stated in the offer, order, or contract. <\/li>
                        • Payments are made cashless to the account specified on the invoice.<\/li>
                        • For deliveries to the Czech Republic, the tax regime applies according to EU and Czech Republic legal regulations.<\/li><\/ul>
                          1. Delivery of Goods<\/strong><\/li><\/ol>

                            5.1 Custom-Ordered Trailers and Goods<\/strong><\/p>

                            • The specific delivery date<\/strong> is always stated in the contract or offer.<\/li>
                            • Delivery may be affected by production, transport, customs procedures, official processes, and other circumstances (including force majeure).<\/li>
                            • The handover location is usually:
                              Kra\u010dansk\u00e1 cesta 40B, Dunajsk\u00e1 Streda<\/strong>,
                              unless otherwise agreed.<\/li><\/ul>

                              Upon customer request, we can also arrange transport to another location \u2013 under the conditions specified in the particular offer or price list.<\/p>

                              5.2 Trailers and Goods 'from Stock'<\/strong><\/p>

                              If a trailer or other goods are marked as in stock<\/strong> and we agree that it is a delivery from warehouse stock:<\/p>

                              • we will hand over the goods within 14 days at the latest<\/strong> from the day when:
                                • the full purchase price<\/strong> has been paid, and<\/li>
                                • we have received the authorization and documents<\/strong> from the customer required for trailer registration (if we are handling the registration).<\/li><\/ul><\/li><\/ul>

                                  The customer is obliged to provide the authorization and documents without undue delay<\/strong> after payment, no later than 3 days, unless otherwise agreed.<\/p>

                                  The delivery period is extended accordingly if:<\/p>

                                  • there is a lack of customer cooperation (authorization, documents), or<\/li>
                                  • there is a delay on the part of authorities or due to force majeure.<\/li><\/ul>

                                    5.3 Registration and the Czech Republic<\/strong><\/p>

                                    • If we are handling trailer registration in Slovakia<\/strong> on behalf of the customer, the customer must provide us with a signed authorization and necessary documents in a timely manner. Without them, we are not in default. <\/li>
                                    • For deliveries to a customer with a registered office \/ business in the Czech Republic, it applies that:
                                      • the customer is obliged to ensure the transfer of ownership \/ registration in the Czech Republic within 30 days<\/strong> from the handover of the trailer,<\/li>
                                      • upon request, they must be able to prove that they have performed this action,<\/li>
                                      • we are not responsible for any potential penalties or administrative consequences if the customer fails to fulfill this obligation.<\/li><\/ul><\/li><\/ul>
                                        1. Ownership and Risk of Damage<\/strong><\/li><\/ol>
                                          • The customer becomes the owner of the goods only after full payment of the purchase price<\/strong>.<\/li>
                                          • The risk of damage (e.g., damage, loss) passes to the customer at the moment when the goods:
                                            • are taken over and the handover protocol is signed, or<\/li>
                                            • were obliged to be taken over, but the customer unreasonably failed to do so.<\/li><\/ul><\/li><\/ul>
                                              1. Warranty and Complaints<\/strong><\/li><\/ol>
                                                • The standard warranty period is 12 months<\/strong> from the handover of the goods.<\/li>
                                                • For some products (especially trailers), an extended warranty of 24 or 36 months<\/strong> can be agreed upon.
                                                  The conditions for the extended warranty (service inspections, possible surcharge, service network) are always specified in the contract, offer, or warranty certificate.<\/li><\/ul>

                                                  The warranty does not cover, for example:<\/p>

                                                  • normal wear and tear,<\/li>
                                                  • damage caused by improper use, maintenance, or unauthorized intervention,<\/li>
                                                  • consumables and parts with a shortened lifespan.<\/li><\/ul>

                                                    Complaints<\/strong><\/p>

                                                    • The customer is obliged to inspect the goods upon receipt and record any apparent defects in the protocol.<\/li>
                                                    • Every defect must be reported without undue delay, no later than 5 days<\/strong> from its discovery.<\/li>
                                                    • Complaints can be submitted by email to info@gastronova.eu<\/strong>.<\/li><\/ul>

                                                      A complaint should include:<\/p>

                                                      • customer identification,<\/li>
                                                      • identification of goods (model, serial number, invoice\/contract),<\/li>
                                                      • description of the defect + ideally photo documentation.<\/li><\/ul>

                                                        We rectify defects within a reasonable period<\/strong>, usually no later than 45 days.
                                                        The method of resolution (repair, part replacement, price reduction) is chosen by the Supplier.<\/p>

                                                        1. Customer Obligations<\/strong><\/li><\/ol>

                                                          The customer undertakes to:<\/p>

                                                          • pay the price on time and in full,<\/li>
                                                          • take over the goods at the agreed time and place,<\/li>
                                                          • use the goods in accordance with the instructions and legal regulations,<\/li>
                                                          • ensure maintenance and service in accordance with recommendations.<\/li><\/ul>
                                                            1. Penalties and Cancellation<\/strong><\/li><\/ol>
                                                              • In case of late payment, we may charge late payment interest of 0.05% daily<\/strong> on the outstanding amount excluding VAT.<\/li>
                                                              • In case of unjustified non-acceptance of goods, we may charge a contractual penalty of 0.05% daily<\/strong> of the purchase price excluding VAT.<\/li><\/ul>

                                                                Cancellation for Custom-Made Trailers<\/strong><\/p>

                                                                Since trailers involve custom manufacturing \/ modification:<\/p>

                                                                • the customer cannot unilaterally withdraw without cause<\/strong>,<\/li>
                                                                • if we nevertheless agree to cancel the contract or order, a cancellation fee equal to the first installment<\/strong> according to the contract applies,<\/li>
                                                                • if the first installment has already been paid, it remains with the Supplier; if not, the customer is obliged to pay it.<\/li><\/ul>
                                                                  1. Privacy Policy<\/strong><\/li><\/ol>

                                                                    We process personal data in accordance with GDPR and legal regulations of SK\/EU.

                                                                    <\/p>

                                                                    1. Changes to GTC<\/strong><\/li><\/ol>

                                                                      Gastronova is entitled to update these GTC periodically.
                                                                      The current version of the GTC is always published on our website.
                                                                      For a specific contract, the version of the GTC effective at the time of its conclusion applies, unless otherwise agreed.<\/p>

                                                                      Note:<\/strong> This is a shortened and simplified version of the GTC intended for easier orientation.
                                                                      The full text of the General Terms and Conditions can be provided upon request.<\/p>
